READ THIS FIRST — THIS IS NOT THE PURCHASE CONTRACT: These Terms explain our business practices, website rules, and client communication standards. Real estate purchases and sales require a formal written contract signed by all parties (typically a Florida Realtors / The Florida Bar "AS IS" Contract) and closing through a licensed Florida title company. Always have a Florida real estate attorney review legal documents before signing.

1. Who We Are

We Buy Any House In Florida LLC ("Company," "we," "us") is a Florida limited liability company and direct cash home buyer serving Jacksonville, Clay County, and Northeast Florida. Our office is located at 179 College Dr Unit 8, Orange Park, FL 32065. Phone/text: 904-606-9163.

Chris Moore is the founder. He is a U.S. Marine veteran and a licensed Florida real estate sales associate (License #SL3389080) affiliated with Momentum Realty / The Moore Group. That license matters when a seller chooses the listing path. It does not change the cash-buyer path.

Two Separate Roles: When we buy your house for cash, the Company acts as a principal (the buyer), not as your real estate agent. We do not owe you fiduciary duties on a cash purchase. When you instead list with Chris through Momentum Realty, that is a brokerage relationship under Florida law and a separate written listing or buyer-broker agreement. You choose the path. We will say so in writing which hat we are wearing.

2. Acceptance of These Terms

These Terms apply whenever you:

  • Visit this website or any affiliated subpage, calculator, net sheet, or guide.
  • Submit an online form, inquiry, property address, or valuation request.
  • Communicate with our team via phone call, text message (SMS), email, or postal mail.
  • Request property showings, market consultations, or valuation assessments.

By accessing this site or communicating with us, you agree to these Terms and to our Privacy Policy and Disclosures. If you do not agree, do not use the website or submit property details.

3. Website Terms of Use

3.1 Informational only

Content on this website (market updates, net sheet tools, guidebooks, and tax calculators) is provided for general informational purposes for Florida homeowners and buyers. It does not constitute legal, tax, accounting, or formal appraisal advice. Consult a Florida attorney, CPA, or licensed mortgage lender regarding your specific scenario.

3.2 Accuracy and market fluctuations

While we strive for precision, market statistics, mortgage interest rates, tax millage figures, and HOA/CDD fees are subject to periodic change. Users must verify property-specific figures through county property appraisers, tax collectors, lenders, and closing agents.

3.3 Intellectual property & acceptable use

All logos, custom calculators, design styles, photography, and written copy belong to We Buy Any House In Florida LLC or its licensors. You may print copies of these Terms for your personal records. You may not scrape, frame, clone, or duplicate site content for commercial real estate competition.

4. How Cash Offers Work

4.1 What an offer is

A cash offer is a private, no-obligation proposal from the Company (or an affiliated buying entity we name in writing) to purchase your property in as-is condition. It is based on condition, estimated repairs, local solds, title flags we can see, and the speed and certainty you want. It is not an appraisal, CMA, BPO, or statement of fair market value.

4.2 No obligation until a contract is signed

You can reject the offer, ask us to revise it, list with an agent (including Chris through Momentum Realty), sell to someone else, or keep the house. We can also withdraw or revise an offer before a contract is fully signed if new facts appear (title, occupancy, unpermitted work, storm damage, payoff higher than disclosed, or access refused).

4.3 What we buy as-is

As-is means you are not required to repair, clean, stage, or paint. Personal property you want to keep should be removed before closing unless the contract says otherwise. Fixtures and attached items typically stay. We still need honest access and honest answers about known issues that are not obvious on a walk-through (open permits, unreleased liens, squatters, HOA violations, pending code cases). Florida seller-disclosure rules still apply to material facts.

4.4 Walk-through and Underwriting

We or our contractors may walk the property, take photos for underwriting, and review public records. If we need a licensed inspector, plumber, or roofer, we pay that cost unless a later contract says otherwise. We repair any damage we cause. A walk-through is not a home inspection for your benefit.

4.5 Price adjustments prior to contract

If the house is materially different from what we were told or could see (hidden structural damage, missing mechanical systems, tenant issues, survey problems), we will say so and either adjust the number or step away. We would rather lose the deal than surprise you at the title company.

5. The Binding Purchase Agreement

When both sides are ready, we use a written Florida purchase contract. For most transactions, that is the standard Florida Realtors / The Florida Bar "AS IS" Residential Contract for Sale and Purchase, plus any applicable riders (condo, HOA, lead-based paint, vacant land, etc.). Either way:

  • Names, legal description, price, earnest deposit, closing date, and occupancy terms are detailed in that signed writing.
  • Earnest money deposits are held in escrow by a licensed Florida title company or closing attorney — never in our business operating account.
  • Title is examined by the title company to ensure marketable title free of unrecorded liens.
  • Closing is conducted through a licensed Florida title company on the agreed date with funds wired or disbursed by check per the ALTA settlement statement.
  • If a contract is assignable, that clause will explicitly say so. If not, it will state non-assignable.

Do not rely on a text message, voicemail, or verbal statement as a binding deal. The Florida Statute of Frauds requires a signed written agreement for the sale of real estate.

6. Fees, Closing Costs, and "No Commission"

On a cash purchase where We Buy Any House In Florida is the direct buyer, you do not pay us a real estate commission. Standard seller-side closing fees still apply per contract (documentary stamp taxes on the deed, title search/closing fees split as negotiated, recording fees, HOA estoppels, and mortgage payoffs). We often cover customary buyer-side closing expenses. The title company's settlement statement governs all exact disbursement figures.

7. Dual Path — Cash Buyer & Licensed Agent

Florida law allows a licensed real estate professional to purchase property as a principal when proper disclosure is made. We disclose our license status here and on any purchase contract. If an open MLS listing will net you more money after accounting for repairs, holding costs, and standard commissions, we will tell you upfront.

In accordance with 2024 NAR practice guidelines, any buyer representation services (if Chris represents you in purchasing another property) require a written buyer-broker agreement prior to property tours.

8. Communications Consent (Calls, Texts, & TCPA Compliance)

By providing a telephone number or email address through an online form or inquiry, you consent to receive informational and transactional communications from We Buy Any House In Florida via phone calls, SMS/text messages, and email regarding your property questions, showing schedules, or closing milestones.

  • Consent is not a mandatory condition of buying, selling, or receiving market valuations.
  • You may opt out of text messages at any time by replying STOP. Reply HELP for assistance.
  • Standard message and data rates may apply. Frequency varies based on your transaction milestones.
  • Telephone calls may be recorded for quality, compliance, and training purposes.
  • We do not sell, rent, or trade your contact information to third-party marketing lists.

9. Fair Housing Commitment

Claims arising from website use are governed exclusively by the laws of the State of Florida, with venue in the appropriate Florida County court.
