Landlords: Know Your Rights Before You Sell

Tired of being a landlord? Before you sell a rental, it helps to know what Florida's Residential Landlord and Tenant Act (Chapter 83, Part II) actually says, because it protects you as much as your tenant. A few things worth knowing:

  • You can sell with a tenant in place. A sale generally does not cancel a valid lease. The new owner steps into your shoes, which is exactly how we buy occupied rentals. You are not required to evict first.
  • Security deposits have rules. Florida law (Fla. Stat. § 83.49) governs how deposits are held and transferred at a sale. Handle it correctly and you stay protected.
  • Ending a tenancy takes proper notice. Notice periods for non-renewal (§ 83.57) and for a tenant breach (§ 83.56) are set by statute. Getting the notice right keeps you out of trouble.
  • No self-help. You cannot change the locks, shut off utilities, or remove a tenant's belongings to force them out (§ 83.67). Removals go through the court.
  • If you are also behind or facing foreclosure, your tenants have their own notice protections (§ 83.561), and so do you. See your rights as a Florida homeowner.
